DATA PROTECTION NOTICE FOR DATA SUBJECTS

This data protection notice is addressed to all data subjects filmed by Sutrans (“Sutrans”, “we”, “us”) through truck cameras.

With this notice, we would like to inform you about the processing of your personal data by Sutrans. This notice specifically concerns the processing of personal data from the cameras located outside of the truck and gives you an overview of your rights in accordance with data protection laws.

3.  Description of data processing, relevant data, and sources of data:

Sutrans processes personal data through its cameras (video footage) located outside of the truck.

4.  Purposes and legal bases for data processing:

Sutrans processes your personal data for the following purposes and bases the processing on its legitimate interest in line with the GDPR:

Legitimate interests of Sutrans (Art. 6 para. 1 lit. f GDPR):

  • increase drivers’ safety by augmenting their field of vision, thereby avoiding accidents
  • prevent damage to Sutrans’ property and employees by vandalism, robbery or violence;
  • collect evidence and support for pursuing claims/against claims in case an incident occurs.

5.  Recipient of data:

Within Sutrans, certain departments and persons require access to the collected data. Access to the footage is restricted to a handful of persons based on the need-to-know principle. In the case of requests from law enforcement agencies, such as the local police, Sutrans might share personal data (video footage) with such agencies. This will however only be done after consulting the data protection officer.

6.  Retention of the footage:

Sutrans processes and retains your personal data according to its retention policy. The video recordings will be kept 25 days. Data which is no longer required for the stated purpose will be deleted, provided that there are no legal storage and documentation obligations that preclude deletion.

7.  Your rights:

You have the right to:

  • access your data as well as receive a copy of your data (Art. 15 GDPR);
  • rectification (Art. 16 GDPR) and erasure (Art. 17 GDPR);
  • restriction of processing (Art. 18 GDPR);
  • data portability (Art. 20 GDPR);
  • object (Art. 21 GDPR);
  • lodge a complaint (Art. 77 GDPR) with the Belgian Data Protection Authority if you believe that the processing of your personal data infringes applicable data protection regulations.
